Terms of Service

This Terms of Service Agreement (“Agreement”) governs the use of services provided by Sparky Host (“Sparky Host”, “we”, “our”, “us”). By ordering, accessing, or using any Sparky Host service, the customer (“Customer”, “User”, “Client”, “you”) agrees to be bound by this Agreement.

If you do not agree with these Terms, you must immediately discontinue use of our services.

Scope of Services

Sparky Host provides digital infrastructure and hosting-related services, including but not limited to:

  • Game server hosting
  • Virtual private servers (VPS) / Cloud services
  • Web hosting and related services
  • Ancillary services, software, or features

All services are provided strictly on an “as-is” and “as-available” basis without warranties of any kind.

Service Provisioning & Activation

Sparky Host services are provisioned on an automated and best-effort basis. Customers acknowledge and agree that:

  • Service activation times are not guaranteed
  • Provisioning delays may occur due to system load, verification, or technical factors
  • Activation delays do not constitute service failure and do not create refund entitlement

Sparky Host reserves the right to delay, reject, or cancel orders where necessary for security, verification, fraud prevention, or operational reasons.

Eligibility & Authority

By using Sparky Host services, you represent that you are legally capable of entering binding agreements and are at least the age of majority in your jurisdiction.

Customer Responsibilities

Customers are solely responsible for maintaining account security, all activities conducted under their account, and proper configuration of services.

Payments, Fees, & Billing

All services are billed in advance. Failure to remit payment may result in immediate suspension. Prices and plans may be modified with notice.

Refund Policy (Strict 24-Hour Limitation)

Refunds are subject to a strict 24-hour eligibility window:

  • ✔Requests must be submitted within 24 hours of initial purchase
  • ✔Applies exclusively to first-time purchases
  • ✔Renewals and upgrades are non-refundable

Chargebacks & Payment Disputes

Initiating a chargeback without first attempting resolution constitutes a material breach and may result in immediate service termination.

Infrastructure Environment & Performance

Sparky Host operates on shared infrastructure unless stated otherwise. Customers acknowledge:

  • Resources are shared with other users; performance may vary and fluctuations are normal
  • Dedicated performance is not implied; we do not guarantee constant CPU levels
  • Service suitability remains the customer’s responsibility

Acceptable Use & Prohibited Activities

Prohibited activities include illegal operations, network attacks (DDoS), malware distribution, phishing, and intellectual property violations.

Fair Usage & Resource Behavior

Services must be used within technically appropriate limits. We reserve the right to restrict, throttle, or terminate services that:

  • Cause infrastructure instability or excessively consume shared resources
  • Negatively impact other users or operate abusive workloads

Such actions may be taken without prior notice to maintain platform integrity.

Node, Hardware, & Network Factors

Hosting services depend on complex systems. Sparky Host is not liable for performance variations resulting from:

  • Hardware limitations/failures or network congestion
  • External provider issues or maintenance/mitigation actions

Service Availability & Interruptions

We do not guarantee error-free availability. No compensation is owed for downtime unless governed by a separate written agreement.

Data Integrity & Backups

Customers are solely responsible for maintaining backups.

Sparky Host disclaims all responsibility for data loss, corruption, or accidental deletions.

Limitation of Liability

Maximum liability shall not exceed the fees paid for the affected service. We are not liable for indirect, consequential, or profit-related losses.

Modifications & Termination

We reserve the right to modify these terms or terminate services for violations. Continued use constitutes acceptance of updated Terms.
