Service Level Agreement

This Service Level Agreement (“SLA”) describes Sparky Host’s general service availability objectives and operational principles. This SLA forms part of the Sparky Host Terms of Service.
This document defines targets and practices only and does not constitute a contractual guarantee of service availability.
Nature of Services
All Sparky Host services are provided on an “as-is” and “as-available” basis.
While we strive to maintain reliable infrastructure and network performance, uninterrupted availability is not guaranteed.
Service Availability Objective
Sparky Host operates on a commercially reasonable best-effort basis to maintain high service uptime and network stability. Any uptime figures represent operational goals rather than legally binding guarantees.
Definition of Service Interruptions
Service interruptions may occur due to factors including, but not limited to:
- Hardware or software failures
- Network disruptions
- Security incidents or mitigation
- Maintenance or upgrades
- Third-party provider issues
- Force Majeure events
Such interruptions are considered normal operational risks inherent to hosting services.
Scheduled & Emergency Maintenance
Maintenance activities are conducted for security, upgrades, and stability. Maintenance events:
- May occur without prior notice where necessary.
- Are excluded from any uptime considerations.
- Do not constitute service failures.
No Automatic Compensation or Credits
Sparky Host does not provide automatic service credits, refunds, or compensation for service interruptions or performance variations.
Customers acknowledge that hosting services involve technical risks and temporary disruptions do not create entitlement to compensation.
Exceptional Remedy Considerations
In rare circumstances involving severe failures directly caused by us, discretionary remedies may be considered. These:
- Are evaluated solely at Sparky Host’s discretion.
- Do not create precedent or obligation.
- May be denied for any reason.
Excluded Events
Sparky Host is not responsible for impact caused by backbone failures, customer misconfiguration, third-party disruptions, or regulatory actions.
Limitation of Liability
Service interruptions shall not give rise to liability for financial losses, data loss, or consequential damages. Liability is strictly limited as defined in the Terms of Service.
Relationship to Terms of Service
This SLA supplements Sparky Host’s Terms of Service. In the event of any conflict, the Terms of Service shall prevail.
Modifications
Sparky Host reserves the right to modify this SLA at any time. Continued use of services constitutes acceptance of updated terms.
